The European Court of Human Rights Justice for 31/01/2006 Rodriguez da Silva and Hoogkamer v. the Netherlands described the family life of its case and stated that the State's positive and negative obligations in will find a fair balance between the individual and society of competing interests. State has, however, a certain degree of discretion. Human rights obligations under Article 8 of the Agreement do not call the State a general obligation to respect the choice of residence of immigrants in the country and not be obliged to accept reunification territory. However, family life and immigration in the state an obligation to allow a resident relatives of admission will vary depending on the issue of persons on the specific circumstances and the general interest.Was also an important aspect of it, whether family life created at a time when the parties concerned had been aware that one of them immigrant status was such that the continuity of family life in the host country from the beginning was uncertain. The European Court of Human Rights has referred to the above case law to the Court 04/26/2007 Konstantinov v. the Netherlands and the Court of 07/31/2008 Darren Omoregia and Others v. Norway. In the former case the Court of Human Rights ruled that in principle it is not unreasonable to demand that the country established in the alien must demonstrate a sufficiently independent and permanent income, which means he can take care of family reunification for a family member's basic livelihoods.

芬兰最高行政法院根据欧洲人权法院的判决**了赫尔辛基行政法院的判决。指出国家没有义务去尊重移民对于家庭团聚地方的选择。尤其是如果婚姻建立的时候。婚姻当事人就不能确定是不是能在居留国家团聚。

芬兰人的配偶要有足够的经济支柱，或者芬兰人要有能力在芬兰养活自己的配偶，只要不吃国家的钱就行。说白了就是，没有钱的外国人统统滚蛋， 要么就带着你的芬兰配偶滚蛋。
